WASHINGTON, D.C. — In a blow to the constitutional rights of citizens, the U.S. Supreme Court ruled 8-1 in Heien v. State of North Carolina that police officers are permitted to violate American citizens’ Fourth Amendment rights if the violation results from a “reasonable” mistake about the law on the part of police. Acting contrary to the venerable principle that “ignorance of the law is no excuse,” the Court ruled that evidence obtained by police during a traffic stop that was not legally justified can be used to prosecute the person if police were reasonably mistaken that the person had violated the law. The Rutherford Institute had asked the U.S. Supreme Court to hold law enforcement officials accountable to knowing and abiding by the rule of law. Justice Sonia Sotomayor, the Court’s lone dissenter, warned that the court’s ruling “means further eroding the Fourth Amendment’s protection of civil liberties…

  1. Wish i’d read the whole thing before commenting. What kind of idiot consents to the searching of his vehicle? I would never permit that and mine is guaranteed 100% clean (brand new truck and I don’t drink or do drugs – though that doesn’t mean a friend couldn’t drop something in there). I agree that it was dodgy allowing the stop but to allow a cop to search your car is ultra-stupid.

    Yes, it was not the best decision, but the cop Took advantage of his rights imo. Authorities overstep their boundaries all the time. Unfortunately It’s now rampant.


  3. Here is the way I see it Jim. Any search that stems from a dependency of a nonexistent law is, by all definitions extremely unreasonable. In fact, It’s unlawful. These Gestapo-like agents regularly break the laws they have sworn to uphold…and therein lies the major problem we have with this corrupted government and its Corporate backers. The Rise of the new Tyranny in the U.S. Or as I like to refer to them as: The N.A. Fourth Reich, who are in concert with the tyrannical Plutocrats of the EU. Together they make up what is known as the Trans Global Tyranny. This new style of modern-quasi Fascist rule and its growing Police State is very dangerous to freedom. I think the West in general is headed for a real paradigm shift, without question, within the next decade a major event is going to happen. But how bloody, how fatal and how wide of a scope it will be, is an unknown…I just hope I can survive it and stay out of the ‘fray’ as much as possible buddy.
